1. Who we are and what these terms cover
PackMule is operated by Stoke Strategies, LLC, a Florida limited liability company ("Stoke", "we", "us"). These Terms govern your use of packmuletcg.com, the PackMule web app, and related services (together, "PackMule"). By creating an account or using PackMule you agree to these Terms and to our Privacy Policy. If you're using PackMule for a business, you agree on behalf of that business.
2. Eligibility
You must be at least 18 years old (or the age of majority where you live) to create an account. PackMule is a tool for selling on marketplaces that themselves require adult sellers, and it isn't directed at children.
3. Your account
You're responsible for your login details and for everything that happens under your account. Tell us right away at support@packmuletcg.com if you think someone else has access to it. One person or business per account; don't create accounts to get around plan limits.
4. Beta
PackMule is in public beta. Features may change, be added, or be removed, and the service may have interruptions or errors. Features described as "coming soon" are not part of what you pay for until they are released.
5. Plans, billing and renewal
- Free plan. Includes a monthly scan allowance and the features listed on our Plans page. We may change the free plan with notice.
- Paid plans. Paid plans are billed in advance, monthly or yearly, at the price shown when you subscribe, plus any applicable tax. Your subscription renews automatically at the end of each billing period at the then-current price until you cancel. We'll tell you about a price change before it applies to you.
- Cancelling. You can cancel anytime from the billing portal linked on the Plans page. You keep your paid plan through the end of the period you've already paid for; after that the account moves to the free plan. Your data and your banked scans stay with your account.
- Changing plans. Upgrades take effect right away and are prorated by our payment processor. Downgrades take effect as the processor applies them.
- Failed payments. If a renewal payment fails, we'll retry it and let you know. If it still can't be collected, the account moves to the free plan.
- Payments are processed by Stripe. We don't see or store your full card number.
6. Scans, rollover and top-offs
- What a scan is. One scan is one card image that PackMule processes and returns a result for (an identified card or a card flagged for review). Requests that are refused (for example because you're out of scans) or that fail on our side are not counted.
- Monthly allowance. Each plan includes a number of scans per calendar month. The allowance resets on the 1st of each month.
- Rollover (paid plans). Scans you don't use in a month roll into your scan bank. Rollover can build your bank up to four times your plan's monthly scans, so the most you can have available in a month is five times your monthly allowance. What rolls over from a month is based on the smaller of the plan you started that month on and the plan you ended it on.
- Top-offs. One-time scan packs. Purchased scans are added to your scan bank.
- Banked scans. Scans in your bank (rolled over or purchased) stay available for as long as PackMule offers the service and your account is open and in good standing, including after you downgrade or cancel your subscription. Scans are used from your monthly allowance first, then from your bank. Banked scans have no cash value, can't be transferred or sold, and are forfeited if your account is terminated for breaking these Terms, fraud, or a payment chargeback.
7. Your marketplace accounts and listings
- Connecting eBay. When you connect your eBay account, you authorize PackMule to act on your instructions through eBay's API: creating, updating and ending listings and offers, reading your inventory and orders, and creating or using business policies (shipping, returns, payment) and a location on your account where needed to publish. We store an encrypted authorization token. You can disconnect at any time from the Connections page or from your eBay account settings.
- You're the seller. You decide what to list and at what price, and you publish it. You are responsible for your listings, prices, descriptions, photos, shipping, returns, taxes, customer service, and compliance with eBay's and any other marketplace's rules and with the law. PackMule never lists anything without you choosing to publish.
- Estimates, not guarantees. Card identification, condition hints, grading suggestions, market prices, fee estimates and "you keep" figures are estimates based on automated analysis and third-party data. They can be wrong. Review every card, price and listing before you publish.
- CSV exports for other marketplaces are files you upload yourself under that marketplace's terms.
8. Acceptable use
Don't use PackMule to: break any law or marketplace rule; list counterfeit, proxy or misrepresented items; upload content you don't have the right to use; scrape, bulk-download or resell PackMule's card data or prices; reverse-engineer the service to build a competing one; probe, overload or attack the service; or get around plan limits. We may suspend or end accounts that do. Where it's reasonable we'll give notice and a chance to fix the problem; for serious abuse we may act immediately.
9. Your content
Your scans, photos, card lists, notes, appraisals and listing text remain yours. You give us a limited license to store, process, copy and display them as needed to run PackMule for you, including sending images to our identification provider, hosting your photos so they can appear in your marketplace listings, and showing an appraisal to anyone you send its share link to. Share links are public to anyone who has the link; don't share one you want private. Deleting an appraisal ends its share link.
10. Our service and third-party content
The PackMule software, design and brand belong to Stoke. Card names, card images and related marks are the property of their owners. PackMule is an independent product of Stoke Strategies, LLC and is not affiliated with, sponsored by or endorsed by Nintendo, Creatures Inc., GAME FREAK inc., The Pokémon Company, eBay, TCGplayer, PSA or any other company named on the site. Card data and prices come from third-party sources and are provided for your own selling decisions.
11. Disclaimers
PackMule is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy and non-infringement. We don't guarantee that identifications, prices, grades or fee estimates are accurate, or that any listing will sell or sell at a given price.
12. Limitation of liability
To the fullest extent the law allows, Stoke will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, lost sales, marketplace fees, account actions taken by a marketplace, or lost data. Our total liability for any claim relating to PackMule is limited to the greater of the fees you paid us in the 12 months before the claim or US $50. Some places don't allow these limits, so they may not fully apply to you.
13. Indemnity
If a third party (including a buyer or marketplace) makes a claim against us because of your listings, your content or your breach of these Terms, you'll cover our reasonable losses and costs from that claim.
14. Ending your account
You can stop using PackMule and ask us to delete your account at any time (see the Privacy Policy). We may suspend or end access for breach of these Terms, non-payment, or if we stop offering the service, in which case we'll give reasonable notice where we can.
15. Changes to these terms
We may update these Terms. If a change is material, we'll give notice by email or in the app before it takes effect. Continuing to use PackMule after that means you accept the updated Terms.
16. Governing law
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Broward County, Florida, except where your local law gives you the right to bring a claim where you live.
